In 2014, the Georgia General Assembly passed OCGA § 16-11-90. The law has been amended several times, including the latest amendment in 2022. Under the current version of OCGA § 16-11-90, a person violates the law if they distribute certain the intimate images of other, without the consent of the person depicted. This includes distributing “a falsely created videographic or still image”, which are commonly referred to as a “deep fake”.
A “deep fake” occurs when one person’s image (most commonly their face) is placed on an image or video of someone else (most commonly their body). Like most everything else on the internet, this technology has spread to pornographic images. Beginning around 2017, realistic deep fake pornographic images of celebrities began appearing on reddit, and elsewhere on the internet. These images contain the faces of celebrities imposed upon the body of pornographic images and videos.
